About Us

  1. Eksteen Attorneys was established in 1995 in Bryanston and subsequently moved to Roodepoort on the West Rand.
  2. The owner Gerhard Eksteen is a qualified attorney and registered with the Law Society of the Northern Province. (add certificate of good standing and fid fund cert)
  3. He obtained his B.Proc degree at the University of the Northwest and a Higher Diploma in Corporate Law at the University of Johannesburg.
  4. He was admitted as an attorney by the High Court of South Africa, Pretoria in 1990.
  5. Since 1995 he has been practising for his own account for the last 21 years.
  6. This fact is proof of our work ethics, commitment to our clients and to the profession.
  7. Our main office is situated in No 5, Panorama Office Estate, 971 Kudu street, Allen’s Nek, Roodepoort.
  8. We mainly operate in the jurisdictions of the Randburg, Johannesburg, Roodepoort and Krugersdorp Courts but we can attend to debt collections nation wide.
  9. Eksteen is the only attorney in the office assisted by approximately10 supporting staff.
  10. We specialize in civil litigation in the High Court as well as any lower Court. This includes:

Debt Collection

  • We have been in the business of debt collection for the past 21 years;
  • We act on behalf of large collection houses and we are able to manage large volumes of collection instructions through sophisticated computer systems
  • We charge a fixed commission on debt actually collected. The percentage will vary from 20 to 35% depending on factors such as the volume of collections, age of the debt, date last contacted, the capital value of the book, etc.
  • We are able to confirm the debtors new address and employment details.
  • We also make use of our own as well as external agents to obtain Consent to judgments. We have at any given moment approximately 20 agents in our employ and they operate in all areas of Gauteng.
  • We have the added advantage above normal debt collectors:
    • We have in depth experience of what work in the field,
    • we are attorneys and as such your funds are protected by our Fidelity Fund;
    • we are also able to proceed immediately with the legal process if need be. Especially in light of the new case law concerning the University of Stellenbosch we understand the required legal process and can attend to our own court appearances.
    • We have access to a variety of data basis to trace the whereabouts of debtors.
    • We can verify online the details of companies and close corporations
    • We can verify online whether the debtor owns any immovable property
    • We can receive instructions online
    • We can provide a status report on thousands of matters with a push of a button
    • We have acted on behalf of several corporate entities and therefor understands the importance of safeguarding your corporate image.

Litigation

  • we litigate in both the Lower and High Court in the jurisdictions mentioned above;
  • we are willing to act as correspondent attorney and we charge party and party tariff without an instruction fee.
  • We don’t bill for work not undertaken by ourselves such as perusing of documentation, drawing, etc.
  • We do however charge R 2 000,00 per hour for court appearances during trials and R 500 per hour during applications
  • We attend to all our own Court appearances

Accounting and reporting

  • Because we have an integrated accounting system and online access to all our Bankers, accounting to client can be done daily, weekly or monthly – depending on client’s needs.
  • Customised management reports are available.
  • We invoice clients on a monthly basis and expect payment of our invoices within 30 days.

BEE

  • We are exempt from the BEE Act as our turnover is less than R 5 mil per annum.
  • However we endeavor to support the spirit of the act by employing more people of disadvantaged backgrounds.
